NOTICE OF DECISION – NEWARK CENTRAL PLANNING BOARD
PLEASE TAKE NOTICE that at the virtual public hearing using the Zoom platform conducted on October 30, 2023 the Newark Central Planning Board adopted an oral resolution approving the application of Habitat for Humanity of Greater Newark (“Habitat”), a non-profit entity, for preliminary and final site plan approval and variances to permit construction of 2 three-family residential structures to provide affordable housing on contiguous property owned by Habitat located in a R-3 Zone at 108 & 110-112 Hawthorne Avenue, designated on the City Tax Map as Block 3569, Lots 24.01 & 24.02.
This proposed development represents Harmony Point Phase 2. Phase 1 was previously approved for contiguous property at 98-106 Hawthorne Avenue, designated as Block 3569, Lots 24.03, 24.04 and 24.05, and a three-family structure was constructed on each of the 3 lots. The end result should be 5 three-family residences subject to affordable housing deed restrictions on contiguous lots along Hawthorne Avenue.
Variances were granted for Harmony Point Phase 2 from building bulk and design requirements in Table 5-2 pursuant to Ordinance Section 41:5-2 as follows:
– Maximum impervious coverage ratio for front yards of 55% to allow a ratio of 56.2% on Lot 24.01.
– Maximum impervious coverage ratio for rear yards of 75% to allow a ratio of 85.4% on Lot 24.01 and a ratio of 78.4% on Lot 24.02.
– Minimum building transparency ratio for primary faade of 30% to allow a ratio of 25.1% for Lot 24.01 and a ratio of 24.0% on Lot 24.02.
– Minimum building transparency ratio for side and rear faades of 10% to allow ratios of 4.1% for the east side of Lot 24.01 and the west side Lot 24.02.
– Maximum fence height of 5′ to allow 6′ fence height.
– Related variances, waivers and/or other approvals as deemed to be necessary.
The oral approval decision was memorialized by adoption by the Newark Central Planning Board of a written resolution at a virtual public meeting using the Zoom platform on Monday, November 6, 2023. The approval was subject to various conditions imposed by the Central Planning Board, as set forth in the written resolution.
