LEGAL NOTICE TOWNSHIP OF BLOOMFIELD ZONING BOARD OF ADJUSTMENT PLEASE TAKE NOTICE that on December 9, 2021 at 7:00 p.m., the Zoning Board of Adjustment of the Township of Bloomfield (the “Zoning Board” or the “Board”) will hold a remote public hearing, pursuant to the instructions set forth below, in connection with property located at 147 Broad Street and 67 Park Place, which properties are designated as Block 252, Lot 1 and Block 251, Lot 5 on the Tax Maps of the Township of Bloomfield, respectively (the “Property”). The Property is currently improved with the Bloomfield Presbyterian Church (a two-story building containing offices and Sunday School classrooms), a one-story Parish House, and a two and a half-story Reverend’s residence. The Property is located within the Township’s R-1A Residential, Single-Family, Fifty Foot Frontage Zone (the “Zoning District”) and the existing use on the Property is a pre-existing non-conforming use. The Applicant, Leonardo da Vinci International Academy of Learning, Inc. (the “Applicant”), has applied to the Zoning Board for preliminary and final site plan approval as well as variance relief from the Township’s Land Development Regulations (the “Code”) to allow a Child Care Center on the Property. Specifically, the Applicant proposes the conversion of five of the eight existing Sunday School classrooms on the second floor of the Church building into a Child Care Center, as well as the installation of a 2,173 square foot outdoor play area, along with other ancillary improvements, including fencing, a bicycle rack, landscaping, and re-striping of existing parking areas. Due to the fact that the proposed Child Care Center use is not a permitted use within the Zoning District, the Applicant is requesting that the Board grant use variance relief pursuant to N.J.S.A. 40:55D-70.d(1) or, in the alternative, grant variance relief to permit an expansion of the pre-existing non-conforming use. Additionally, the Applicant requests that the Board grant a design waiver or variance relief in connection with the size of four proposed parking stalls, whereas a minimum width of 9 feet and a minimum depth of 18 feet is required, and Applicant proposes a width of 8′- 8″. Additionally, to the extent deemed necessary by the Board, the Applicant requests relief to maintain existing non-conforming conditions and/or previous variance relief, including with regard to the minimum number of required parking, minimum rear yard setback, maximum building coverage, maximum lot coverage, and existing building height. Lastly, the Applicant requests that the Board grant any additional approvals, permits, variances, interpretations, waivers or exceptions reflected in the plans and materials filed (as same may be amended or revised from time to time without further notice) or determined to be necessary during the review and processing of the application.
