Alina Habba disqualified from her position as N.J.’s acting U.S. attorney, appeals court rules

Alina Habba is disqualified from her position as N.J.’s acting U.S. attorney, or top federal prosecutor, following a court ruling. United States Third Circuit Court of Appeals Judge D. Michael Fisher ruled that Habba’s appointment is unconstitutional because Habba was not confirmed by the Senate or appointed by district trial court judges. Fisher’s ruling upholds an August court ruling that Habba has been unlawfully serving as acting U.S. attorney. Judges did not specify who the current state federal attorney is, and it is not yet clear whether the case will be taken to the Supreme Court.
