A federal district court judge recently approved a settlement in a class action lawsuit between a group of special education families and N.J.’s Department of Education. The lawsuit claimed the N.J. DOE was violating federal and state law by delaying due processing for services for children with disabilities, with waits for a decision from an Administrative Law Judge reaching up to 212-312 days, rather than the required 45 days. In 2019, less than 5% of due process complaints within N.J. were resolved in a timely manner. According to the settlement, the court will appoint a compliance monitor to oversee the department’s adherence to the agreement and provide reports to the public every four months. The department must achieve a 95% compliance rate for a four-month period.
